01The service

Prezntly is a private network for giving gifts to the people you love: wish lists, circles, occasions, Secret Santa, group gifts and a browser extension. It is published by ark.swiss Sàrl, based in the canton of Vaud, Switzerland.

These terms apply to the prezntly.com website, the app and the extension. By creating an account or using Prezntly, you accept them. Our privacy policy explains how we handle your data.

02Your account

• Give accurate information and keep it up to date.
• Your account is personal: one account per person, and your password stays secret.
• If you are a minor, ask a parent before creating an account. Children don’t need an account: an adult can add them to their circle.
• If you think someone is using your account, change your password and let us know.

03What you post

Your lists, photos and messages remain yours. You only allow us to host them and show them to the people you share them with, so that Prezntly can work. This permission ends when you delete them.

Only post what you have the right to post. Images and descriptions taken from shops belong to them: they are only used to recognise the product.

04What isn’t allowed

Prezntly is built on trust. You may not:

• harass, deceive or harm anyone;
• post content that is illegal, hateful or infringes other people’s rights;
• add a person without an account against their will;
• send advertising or unsolicited messages;
• get around security, collect data in bulk or disrupt the service.

05Loved ones without an account

When you add a child or an adult without an account, you do so with their consent, or their parents’ consent for a child. You agree to remove their information if they ask.

06Gifts, group gifts and shops

• Prezntly doesn’t handle any payments. In a group gift, everyone states their share and the money goes directly between you, for example via TWINT or bank transfer.
• Prezntly doesn’t sell anything: you buy from the shops, on their terms.
• Prices, images and availability taken from shops can change, so check them before you buy.
• Prezntly doesn’t currently use any affiliate links. If that changes, we will say so clearly.

07Secret Santa

The organiser sets the rules: participants, budget, date, exclusions and, if they wish, fixed pairs. The draw follows these rules and everyone only discovers their own person. The gifts themselves are up to the participants.

08The browser extension

The free extension adds a product you’ve found in an online shop to your list. It recognises product pages right in your browser and only sends Prezntly the product you choose to add. The rules of your browser’s extension store also apply.

09Free, and always improving

Prezntly is free. If that ever changed, we would tell you in advance, and you would never be charged without your consent.

We keep improving Prezntly: features may appear, change or disappear.

10Availability and liability

We do our best to keep Prezntly running well and without interruption, but we can’t guarantee it: maintenance or an outage can happen.

To the extent permitted by law, we are not liable for indirect damage, nor for what happens between members or with shops. Our liability remains in full for intentional misconduct or gross negligence.

11Suspension and deletion

You can delete your account at any time from your settings. We may suspend or close an account that doesn’t respect these terms, with prior notice except in urgent cases.

12Changes

If we change these terms significantly, we’ll let you know in advance in the app or by email. If you keep using Prezntly afterwards, the new terms apply; if not, you can delete your account.

13Governing law

These terms are governed by Swiss law. In the event of a dispute, the courts of the canton of Vaud have jurisdiction. If you use Prezntly as a consumer, the mandatory rules of your country of residence still apply.
